Build A Sign LLC (“BAS,” “we,” “us,” or “our”) respects your concerns about privacy. This Privacy Policy describes the types of personal information we obtain about consumers via www.upsstoreprint.com (the “Website”), and all related applications, software, and services (collectively, with the Website, the “Services”). This Privacy Policy also describes how we may use the information, with whom we may share it, and the measures we take to safeguard the personal information we collect. In addition, we tell you how you can ask us to (i) refrain from sending you marketing email communications, and (ii) answer questions you may have about our privacy practices.

  • The Services are provided by BAS under license from The UPS Store, Inc. (“TUPSS”). The Services allow you to create and purchase customized print materials, merchandise, signs, magnetics, bumper stickers, and banners ("Products”).
  • Products will be produced and delivered to you either by BAS itself directly or, if you elect, by a The UPS Store location within the United States (a “Center”). Each Center is an independently operated, franchised location and this Privacy Policy does not apply to the collection of information by a Center.
  • This Privacy Policy does not apply to TUPSS, which is subject to its own Privacy Policy that can be found.
  • This Privacy Policy does not apply to the collection of consumer information by any Center and, once we transfer Your Data (as defined in the The UPS Store Center Terms of Use); the privacy policy of that Center, not this Privacy Policy, will apply to the use of that information.

Information We Obtain

The types of personally identifiable information (“PII”) that we may obtain include:

  • Individual and business contact information (such as name, company name, physical address, email address, and telephone number);
  • Payment information (including payment card details);
  • Information about your transactions with us, such as Products and services you purchase;
  • Information provided in response to surveys;
  • Username, password and other credentials used to access the Services, including information in your public social media profile if you register via a social media website or tool;
  • With your permission, the geographic location of your mobile device;
  • Information you may upload to our Services, such as information contained in content you upload for printing services or otherwise contained in Your Data
  • Personal information of other individuals that you provide to us; and
  • Other personal information that may be provided to us to obtain a Product or service.

We collect this PII from you and your device, as well as from our service providers, including the Centers. If you disclose any PII relating to other people to us or to our service providers in connection with the Services, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Policy.

In addition, when you use our Services, including when you interact with the Services and their related tools, widgets or plug-ins, we may collect certain information by automated means, such as IP address (from which we may derive your approximate location), unique device identifier, browser characteristics, device characteristics, operating system, language preferences, referring URLs, , information on actions taken, and dates and times of activity.

When you visit our Services, this information may be collected through “cookies” and “web beacons.” A “cookie” is a text file sent to a visitor’s computer or other Internet-connected device to uniquely identify the visitor’s browser or to store information or settings in the browser. A “web beacon” also known as an Internet tag, pixel tag or clear GIF, links web pages or applications to web servers and may be used to transmit information back to a web server. Through our automated collection efforts, we obtain and store “clickstream data” to tell us usage patterns.

We also may use third-party web analytics services on our Services, such as those of Google Analytics and Listrak. How We Use The Information We Obtain

We may use each category of information we obtain to:

  • Provide and arrange for Products and services you request, such as printing;
  • Process and collect payments;
  • Provide customer support and respond to and communicate with you about your requests, questions and comments;
  • Communicate with you about Products and services we believe may interest you;
  • To provide you with personalized location-based services and content;
  • Communicate about, and administer your participation in, surveys, contests, sweepstakes, and other offers or promotions. ;
  • Establish and manage your accounts;
  • Verify your identity;
  • Enable you to post Product reviews on the Services;
  • Send information to your contacts if you ask us to do so;
  • Process claims we receive in connection with Products and services you request;
  • Operate, evaluate and improve our business (including developing new products and services; managing our communications; determining the effectiveness of our sales, marketing and advertising; analyzing and enhancing our products and services; and performing accounting, auditing, billing, reconciliation and collection activities);
  • Perform data analyses (including market and consumer research, trend analysis and financial analysis);
  • Protect against, identify and prevent fraud and other criminal activity, claims and other liabilities; and
  • Comply with applicable legal requirements and our policies.

In addition, we use information collected online through cookies, web beacons and other automated means for purposes such as (i) customizing our users’ visits to our Services, (ii) delivering content (including advertising) tailored to our users’ interests and the manner in which our users browse our Services, and (iii) managing our business. We also use this information to help diagnose technical and service problems, administer our Services, identify users of our Services, and gather demographic information about our users. We use clickstream data to determine usage patterns and how we may tailor our Services to better meet the needs of our users.

We also may use the information we obtain about you in other ways for which we provide specific notice at the time of collection.

We do not process your PII for profiling in furtherance of “decisions that produce legal or similarly significant effects” as such term is defined under applicable law.

Interest-Based Advertising

On the Services, our third party analytics providers may collect information about your online activities for use in providing you with advertising on other websites about products and services tailored to your individual interests.

These companies track your online activities over time by collecting information through automated means, including through the use of cookies, web server logs and web beacons. The networks use this information to show you advertisements that may be tailored to your individual interests. The information these companies may collect includes information about your visits to websites that participate in such parties’ advertising networks, such as the pages or advertisements you view and the actions you take on the websites. This data collection takes place both on our Services and on third-party websites that participate in the ad networks. Information We Disclose

We do not sell or otherwise disclose PII about you, except as described in this Privacy Policy.

Some of the Products you purchase through the Services will be produced and delivered to you by a Center, not BAS. We disclose PII to such Centers for use in connection with the production and delivery of the Products you purchase. The Centers have their own Terms of Use and Privacy Polices. Once we transfer Your Data, including PII, to the Centers, their use of Your Data is covered by the Center’s own Terms of Use and Privacy Policy, not this Privacy Policy or our Terms of Use.

You may elect to have us share your PII with TUPSS. Once we transfer your PII to TUPSS, the use of such PII is covered by TUPSS’ own Privacy Policy, not this Privacy Policy.

We also disclose PII to third parties who perform services on our behalf based on our instructions. These third parties are not authorized by us to use or disclose the information except as necessary to perform services on our behalf or comply with legal requirements. We also may disclose information to our affiliates and shipping carriers.

By using the Services, you may elect to disclose PII, for example, as part of reviews you post on the Services. Please note that any information you post or disclose through the Services will become public and may be available to other users and the general public. If you register via your social media account, you will disclose information to your friends associated with your social media account, with other users of that social media service, and with your social media account provider. By registering, you authorize us to facilitate this disclosure of information, and you understand that the use of disclosed information will be governed by the social media provider’s privacy policy.

Information collected through third-party apps, tools, widgets and plug-ins (such as information obtained through third-party login services or relating to your use of a Facebook “Like” button) is collected directly by the providers of these features. This information is subject to the privacy policies of the providers of the features, and we are not responsible for those providers’ information practices.

BAS also may disclose information about you (i) if we are required to do so by law, regulation or legal process (such as a court order or subpoena); (ii) in response to requests by government agencies, such as law enforcement authorities; (iii) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity; or (iv) as otherwise permitted by applicable law. We reserve the right to transfer any information we have about you in connection with the sale or transfer all or a portion of our business or assets (including in the event of a reorganization, dissolution or liquidation).

For your convenience and information, the Services may contain links to Centers or to other sites that may be operated by third parties. The inclusion of such links does not imply endorsement of the linked site or service by us or by our affiliates. These companies may have their own privacy policies or notices, which we strongly suggest that you review. We are not responsible for the privacy practices of any other site or the services offered on that site.

How We Protect Personal Information

We seek to use reasonable administrative, technical and physical safeguards designed to protect PII within our organization. Unfortunately, no information transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure, please immediately notify us in accordance with the “How To Contact Us” section below.

Use of Services by Minors

If you are under the age of 18, but at least 13 years of age, you may use the Services only under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use. We do not knowingly collect PII from individuals under 18 without the consent of their parent or legal guardian and do not knowingly collect PII from individuals under 13.

Updates To Our Privacy Policy

We may revise and update this Privacy Policy at any time and shall post a notice of the updated Privacy Policy or otherwise notify you of such updates. Your continued usage of the Services after any changes to this Privacy Policy will mean you accept those changes.

We do not sell and have not sold PII, including sensitive personal information, within the preceding 12 months. Purposes for the Collection and Use of Sensitive Personal Information

We only use sensitive personal information with your consent and only for the purposes for which you have provided such consent.

Retention Period

We retain PII for as long as needed or permitted in light of the purpose(s) for which it was collected. The criteria used to determine our retention periods include:

  • The length of time we have an ongoing relationship with you and provide services to you, for example, for as long as you have an account with us or keep using our services, and the length of time thereafter during which we may have a legitimate need to reference your PII to address issues that may arise;
  • Whether there is a legal obligation to which we are subject, for example, certain laws require us to keep records of your transactions for a certain period of time before we can delete them; or

You have the right to be free from unlawful discrimination for exercising your rights under applicable law.

In addition, to the extent required by applicable law, California residents may ask us to provide them with (i) a list of certain categories of PII that we have disclosed to third parties for their direct marketing purposes during the immediately preceding calendar year, and (ii) the identity of those third parties. Appeal Process

Authorized Agents

If an agent would like to make a request on your behalf as permitted under applicable law, the agent may use the submission methods noted in the section entitled “Rights and Requests.” As part of our verification process, we may request that the agent provide, as applicable, proof concerning his or her status as an authorized agent. In addition, we may require that you verify your identity as described in the section entitled “Rights and Requests” or confirm that you provided the agent permission to submit the request.

De-Identified Information

Where we maintain or use de-identified information, we will continue to maintain and use the de-identified information only in a de-identified fashion and will not attempt to re-identify the information.
